These Terms of Service ("Terms") govern your use of the Creator AIOS website and the services provided by Creator AIOS ("Creator AIOS", "we", "us", or "our"), operated by Derek Kumo. By using our website, submitting an inquiry, or purchasing a build, you agree to these Terms.

01What we offer

Creator AIOS designs and builds custom AI operating systems for creators. This includes done-for-you builds delivered on your own subdomain or domain, optional hosting, support and updates on a monthly subscription, and the Creator AIOS Thumbnail System, a private AI thumbnail app delivered as a one-time build with optional monthly hosting.

02Inquiries and engagements

Submitting the inquiry form or contacting us does not create a contract or reserve a build. A project begins only once scope and price are agreed in writing and any required payment has been made. Quotes are valid for the period we state and may change if your requirements change.

03Payment

Build fees are billed as a one-time charge or on an agreed schedule. Hosting, support and updates are billed monthly and recur until you cancel. Payments are handled by our third-party payment processor. Prices are in US dollars unless stated otherwise. By purchasing a subscription, you authorize us and our processor to charge the recurring fee to your payment method until you cancel.

04Your responsibilities

• Provide accurate information and timely materials needed to build your system.
• Provide and maintain any third-party accounts or API keys required to run your system, for example a Google AI key for thumbnail generation. You are responsible for those providers' fees and terms.
• Use your system and our website lawfully, and not for content that is illegal, infringing, deceptive, or harmful.

05Ownership

You own the content you create and the specific build we deliver to you, and you may export and host it elsewhere. We retain ownership of our underlying frameworks, templates, and reusable components, which we license to you for use within your build. You may not resell or redistribute our underlying software as a competing product or service.

06Third-party services

Our website and the systems we build rely on third parties, including Vercel for hosting, Google for AI generation, our payment processor for billing, and Web3Forms for our inquiry form. Their availability, pricing, and terms are outside our control, and your use of them is subject to their own terms.

07Acceptable use

You agree not to use our services to create or distribute unlawful, infringing, or harmful content, to disrupt our services, or to reverse-engineer or copy our underlying software beyond your own delivered build. We may suspend or end services for violations of these Terms.

08Disclaimers

We provide our services with reasonable skill and care. Except as expressly stated in these Terms or a written agreement, our services are provided "as is". AI-generated outputs can contain errors, and you are responsible for reviewing them before you publish. We do not guarantee specific results, including views, revenue, rankings, or growth.

09Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or our services is limited to the amounts you paid to us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits or data.

10Cancellation and termination

You may cancel a monthly subscription at any time, effective at the end of your current billing period. On cancellation you keep your delivered build, and only hosting, support and updates stop. We may suspend or terminate services for non-payment or breach of these Terms.

11Refunds

Refunds are covered by our Refund Policy, which forms part of these Terms.

12Changes and governing law

We may update these Terms from time to time. Material changes take effect when posted on this page, with an updated date. These Terms are governed by the laws applicable where the operator is established, without regard to conflict-of-laws rules.
